1. About HPLocker

HorsepowerLocker.com is an online classified marketplace that connects private sellers and dealers with buyers interested in powersports equipment, tractors, lawn and garden equipment, parts, accessories, and related items. HPLocker is a platform only — we are not a buyer, seller, broker, dealer, or auctioneer, and we are not a party to any transaction between users.

2. Eligibility

You must be at least 18 years of age to create an account or post a listing. By using the site, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. User Accounts

  • You are responsible for maintaining the security of your account credentials.
  • You may not share your account or use another user’s account.
  • You are responsible for all activity that occurs under your account.
  • HPLocker reserves the right to suspend or terminate accounts that violate these Terms.

4. Listing Rules

When posting a listing on HPLocker, you agree that:

  • You are the owner of the item or are authorized to sell it.
  • All listing information (description, photos, price, condition, mileage, year, make, model) is accurate and not misleading.
  • The item is legal to sell in your jurisdiction.
  • You will not post duplicate listings or spam the marketplace.
  • Photos must be of the actual item for sale — stock photos or images from other listings are not permitted.
  • You will promptly remove or mark as sold any listing once the item is no longer available.

Prohibited listings include: stolen property, recalled items with unresolved safety defects, items with fraudulent titles or VINs, or any item prohibited by applicable law.

5. No Warranty on Listings

HPLocker does not inspect, verify, or warrant any item listed on the platform. All listings are provided “as is.” Buyers are solely responsible for inspecting items, verifying titles, and conducting their own due diligence before completing any purchase. HPLocker strongly recommends meeting in a safe public location and verifying ownership documents prior to any transaction.

6. HPLocker Is Not Responsible for Transactions

HPLocker provides a platform for users to connect — we do not facilitate payments, transfers of title, or physical delivery of items. We are not responsible for:

  • The accuracy or completeness of any listing
  • The condition, safety, or legality of any item listed
  • Any disputes, fraud, injury, or loss arising from a transaction between users
  • Failure of a buyer or seller to complete a transaction

Use your best judgment and exercise caution when buying or selling through any online marketplace.

7. Dealer Accounts

Dealer accounts are subject to additional terms and are intended for licensed or professional sellers. By registering as a dealer, you represent that your business operates in compliance with all applicable federal, state, and local laws governing the sale of vehicles, equipment, and related products. HPLocker reserves the right to verify dealer status and revoke dealer privileges at any time.

8. Prohibited Conduct

You agree not to:

  • Post false, misleading, or fraudulent listings or information
  • Harass, threaten, or abuse other users through our messaging system
  • Attempt to circumvent our platform by taking transactions off-site to avoid future accountability
  • Scrape, copy, or reproduce site content without permission
  • Use automated tools (bots, scrapers) to access the site
  • Attempt to hack, disrupt, or gain unauthorized access to the site or other users’ accounts

9. Intellectual Property

The HPLocker name, logo, and site design are the property of HorsepowerLocker.com. By posting photos and listing content, you grant HPLocker a non-exclusive, royalty-free license to display that content on the platform and in promotional materials. You retain ownership of content you post.

10. Limitation of Liability

To the fullest extent permitted by law, HPLocker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the site, including but not limited to losses from transactions, fraud by other users, or reliance on listing information. Our total liability to you for any claim shall not exceed $100.

11. Indemnification

You agree to indemnify and hold harmless HPLocker, its owners, employees, and agents from any claims, damages, or expenses (including attorney’s fees) arising from your use of the site, your listings, or your violation of these Terms.

12. Termination

HPLocker may suspend or terminate your account and access to the site at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which HPLocker operates, without regard to conflict of law principles. Any disputes shall be resolved in the applicable state or federal courts.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the site after changes are posted constitutes your acceptance of the updated Terms.
